Judge Denies Hayes' Challenge to Death Penalty

Judge Jon C. Blue has denied the motion Steven Hayes' attorneys filed for a new trial or to throw out the death penalty.

Hayes was convicted of killing Jennifer Hawke-Petit and her daughters during a 2007 home invasion in Cheshire.

Last week, Hays' defense team argued that Hayes should get a new trial because of statements jurors made during media appearances after the verdict, and claimed jurors made decisions based on emotion.

Judge Blue said the jury deliberated for two days before acquitting Hayes of first-degree arson and four four days before delivering a sentencing verdict.

"This is not the behavior of a jury driven by passion and prejudice," Blue wrote.
