Delay for Justice

It's been more than two years since the deadly home invasion in Cheshire, but the two suspects in the case have yet to stand trial.

In court Friday, defense attorneys for Steven Hayes argued the book, "In the Middle of the Night" could taint the jury pool.   Brian McDonald's interviewed fellow suspect Joshua Komisarjevsky in the book.

Defense attorneys want more time to look at sealed documents to determine if the Department of Correction was negligent for allowing him to visit Komisarjevsky in prison for the interviews.

"One would think they would be the top of their game when they are in charge of two of the most infamous prisoners," Dr. William Petit said.

A judge ruled the defense had 10 days to file a motion to postpone jury selection.

"It's been 28 months and it seems like they're filing motions to delay things as long as possible," Petit said.

He is asking Attorney General Richard Blumenthal to investigate if there was any money exchanged involving the interviews.

"We understand and respect Dr. Petit's concerns, which we share, and we will do everything we can to address them," Blumenthal said in a statement.

Komisarjevsky and Hayes could face the death if convicted of murdering Jennifer Hawke-Petit, Hayley and Michaela Petit.
