Millionaire Fights Mohegan Sun Over Debt

Courts have no juridiction because it's casino land, he claims.

The millionaire chief executive of Plum TV, who is accused of walking out on a $1.2 million gambling debt, wants an appeals court to throw out a ruling that would allow Mohegan Sun to seize his assets.

Jerome "Jerry" Powers, of Miami Beach, Florida, claims that the credit agreement he signed is invalid under state law and state courts have no jurisdiction because the sovereign Mohegan Tribe runs the casino.

Powers has been fighting Mohegan Sun's attempts to recoup the gambling debt in civil court since it sued him in November 2009.

He filed an appeal with the state Appellate Court early this week.

It's not clear when the Appellate Court will take up the appeal.

A lawyer for the casino declined to comment.

Plum TV is a lifestyle network catering to people in Aspen, The Hamptons, Martha’s Vineyard, Miami Beach, Nantucket, Sun valley, Telluride and Vail.

Powers launched Plum to get back at his former business partner at Ocean Drive, who became his rival, the New York Daily News reports
