Komisarjevsky's Daughter's Testimony on Wednesday: Report

The jury will hear the 9-year-old's videotaped testimony.

A forensic psychiatrist will take the stand today in the trial for convicted home invasion murderer Joshua Komisarjevsky and testimony from Komisarjevsky's daughter is expected to be played on Wednesday.

The jury is hearing testimony to decide whether Komisarjevsky gets the death penalty or life in prison for killing Jennifer Hawke-Petit and her two daughters, Hayley, 17, and Michaela, 11.

Raymond Hassett, an attorney for the state-appointed guardian for Komisarjevsky's daughter, said the hour-long tape will be shown in court in on Wednesday and he hopes the girl remains "unaffected by the whole situation."

Judge Jon Blue ruled that only the jury will be able to see the video and credentialed members of the media can watch it at some later point. 

Lawyers for Joshua Komisarjevsky sought the girl's testimony as they work to spare him the death penalty.

On Friday, a man who served prison time with Komisarjevsky before the 2007 killings testified that Komisarjevsky was polite and studious in jail, but "emotionally dead."

Sean Baraby took the witness stand on Friday in the penalty phase of Komisarjevsky's trial in New Haven as aKomisarjevsky’s co-defendant, Steven Hayes, is already on death row.

Baraby said he served three months in state prison in 2005 with Komisarjevsky, who was locked up for a string of burglaries and later paroled. He said Komisarjevsky took him under his wing.

The defense said Komisarjevsky has redeeming qualities and should be spared the death penalty.
