Two New Jersey men have sued Milford, Conn.-based Subway, saying the fast-food chain has been shorting them on its so-called footlong sandwiches.
The issue of the sandwich size got widespread attention last week when an Australian man posted a photo of a sandwich and a ruler on the company's Facebook page.
The filing made on Tuesday seeks compensatory damages from the company and a change in practices.
Stephen DeNittis, lawyer for the plaintiffs, said the company should either make their sandwiches 12 inches long or stop advertising them as footlongs.
He said he's measured sandwiches from 17 area shops and not one has been 12 inches long.
Subway does not comment on pending litigation but released the following statement:

We freshly bake our bread throughout the day in our more than 38,000 restaurants in 100 countries worldwide, and we have redoubled our efforts to ensure consistency and correct length in every sandwich we serve.
