Judge Orders Jodie Sweetin & Estranged Husband To Temporarily Share Custody Of Daughter

A judge has told former “Full House” star Jodie Sweetin she can only see her 8-month-old daughter when she is at her parents’ home or in their presence, after her estranged husband raised questions about her sobriety.

Jodie’s husband, Cody Herpin, whom she is divorcing, called for an emergency hearing in an Orange County court over the former couple’s infant daughter, Zoie, after alleging the actress has fallen off the wagon.

“It’s primarily alcohol [abuse] but there’s also concern regarding methamphetamines,” Cody’s lawyer, Robert Benavente, told People.

Jodie’s own counsel, Wilma Presley, has strongly denied the allegations that the former meth addict is using again.

“Jodie absolutely has not relapsed into using meth,” Presley told the mag. “She merely confessed to having several glasses of wine over dinner recently and felt guilty about that. She is currently in a 12-step program and is working hard on her sobriety. She wants to be clean and sober from everything.”

While the court sorts fact from fiction, a judge has temporarily ruled that Jodie has to either be in the presence of her own parents, or in their home, when seeing her daughter, Access Hollywood has learned. The judge also ordered the former couple share custody 50-50.

A follow up court hearing has been set for February 9, 2009.

In the run up to the next court hearing, both Jodie and Cody have been ordered to submit to urine based drug tests.
