Busy Judges Don't Have to Hang Up Robes at 70

When a Connecticut judge turns 70, it’s time to hang up the robes, unless he or she is in the middle of a case. Then, they can continue cranking through statutes and rule with their colleagues.

The state Connecticut Supreme Court has divided but decided, 4-3, to keep the state law as is. The reason for deciding on this is the case of Greenwich police Lt. F. Gary Honulik, who sued the department after he got the highest score on a captain's test in 2003 but wasn't promoted.

A trial court judge ruled in Honulik’s favor, but the Supreme Court overruled that decision earlier this year.

Then, Honulik asked the Supreme Court to reconsider and said Justice Barry Schaller turned 70 before the majority opinion he wrote was released.

The Supreme Court ruled Monday that the law at issue does not contradict the state constitution, which sets the retirement age.
