Insurance Company Balks at Claims in Fatal Fire

Insurance company said contractor misrepresented the type and scope of work he did.

An insurance company said it should not have to pay claims stemming from a Christmas morning fire in Stamford that killed five people because a contractor renovating the house misrepresented the type and scope of work he did.

Lily, 9, 7-year-old twins Sarah and Grace Badger, and their grandparents, Lomer and Pauline Johnson were killed in fire.

The girls’ mother, Madonna Badger, and Michael Borcina, were the only survivors of the fire, attributed to a bag of smoldering ash and embers left in a first-floor mudroom.

Borcina, a contractor, was renovating the house.

Utica First Insurance Co. argues in a lawsuit filed this week in New York that Borcina misrepresented the number of employees with his construction company, its sales and payroll, and size and type of work performed. The company said if it knew the facts, it would not have issued coverage.

An attorney for Borcina, who escaped the fire, said he's disappointed with the insurer.
