New Haven Sued Again Over Promotion Exam

A black firefighter says scoring method hurts African-Americans

Four months the Supreme Court sided with a group of 20 New Haven white and Hispanic firefighters who sued the city for reverse discrimination, a black New Haven firefighter has filed a federal lawsuit.

Michael Briscoe filed a suit on Thursday against the city over a promotion exam that was the subject of a landmark ruling.

In June, the Supreme Court ruled that city officials were wrong to scrap the 2003 test results because too few minorities would have been promoted.

Briscoe claims the city wrongly gives more weight to the test's written part than the oral section, and that scoring method has a disparate effect on African-Americans.

In 2003, Briscoe said, he received the top score on the oral part but he wouldn't have been promoted under the city's scoring method.

He's looking for the promotion and back pay.
