Prosecutors in Home Invasion Case Cannot Access Psych Records

Judge Jon Blue has rejected prosecutors’ request for statements Steven Hayes made to a psychiatrist.

Hayes was convicted last week of 16 counts for killing Jennifer Hawke-Petit and her daughters, Hayley, 17, and Michaela, 11, in their during in Cheshire in 2007.

Judge Blue made the ruling on Friday, as lawyers on both sides prepared to begin presenting evidence to jurors who will decide whether Hayes gets life in prison or a death sentence. The penalty phase of the trial begins Monday.

Prosecutors wanted statements Hayes made to a psychiatrist the defense hired. Blue said the requirements for the defense to disclose material to prosecutors is limited.
