Off the Hook for Retaliatory Lick

A Naugatuck man is off the hook on sex assault charges that were filed over a retaliatory lick.

The trouble for Richard Giattino, 49, started last month when he was standing in his yard and a 12-year-old hit him with a ball. He got so upset that he chased the girl down and licked her face, police said. At the root of that anger? His back problems, he told police.

Giattino was charged with fourth-degree sexual assault, risk of injury to a minor and second-degree breach of peace.

The state's attorney's office has decided not to prosecute the case, court records show. So that kills the case unless new evidence turns up that make prosecutors reopen the case. Giattino has to stay out of trouble for 13 months.
