Record: Teen Accused of Rape Went in to “Look Around”

A teenager accused of the rape and choking of a 25-year-old woman in her New Milford condo saw an open window, ripped the screen down and climbed in to "look around".  He will be tried as an adult.

Elias Garcia, 15, was supposed to be sleeping at a friend’s nearby home but left around 2 a.m. on Aug. 6 and walked back toward the Willow Springs complex, where he lives, the Danbury News Times reports, citing the arrest warrant affidavit.

As Garcia wandered, he spotted an open front window, walked over and “ripped the window screen down,” the News Times reports, citing the warrant.

"I climbed in the window. I went just to look around. At some point I went into the bedroom. I saw a lady sleeping in the bed,” he said.

The victim tried to fight back and thought she was going to die, documents state.

"I kept kicking and I tried to move his hands ... to get his hands off my neck. I couldn't breathe, I was fighting to breathe," the victim stated in the affidavit. "I tried to poke the person in the eye ... I kept thinking to myself 'I'm going to die.' ''

The victim became unconscious. Garcia, the affidavit states, escaped through the window, took the screen and candles, discarded them and went to a playground to sleep before returning to his friend’s house, the paper reports.

Some neighbors identified Garcia and police arrested him. He is charged with first-degree sexual assault, first-degree strangulation and first-degree burglary.

Garcia told police, "The reason I choked out the lady was because she woke up and I got scared,'' the News Times reports.
