We should know by 5 p.m. Tuesday whether Lt. Gov. Michael Fedele and his running mate, Mark Boughton, qualify for public campaign money.
The Republican candidate for governor decided to participate in the state's public finance program and is looking to get more than $2 million for his campaign, but one of his opponents, Tom Foley, said Fedele and Boughton illegally double-counted the contributions to qualify for public funding.
Foley went to court on Monday in an attempt to stop the funds and his lawyer said granting Fedele the money would do serious financial damage to the Foley campaign.
The decision will come the same day that the federal appeals court threw out part of the state’s public financing law.
The appeals court agreed the state should not be required to give extra public funding to a candidate running against a wealthy, privately funded opponent, saying that would infringe on the wealthy candidate's free speech rights.
