SELECTION AND NOTIFICATION OF FIRST ROUND FINALISTS AND WINNER: There will be two (2) rounds of judging: Round 1: Initial Judging to Determine the Finalists; Round 2: Public Voting and Final Judging to Determine Winner.
Round 1: Initial Judging to Determine the Finalists: On or about November 15, 2018, one (1) or more qualified judges selected by Sponsors (“Judges,” each a “Judge”) will review all eligible Entries received during the Contest Period and select up to up to five (5) finalists (“Finalists,” each a “Finalist”) based on the following judging criteria (“Judging Criteria”): Quality of sound and singing (33.3%), Tone and Style (33.3%), and Overall Excellence to Theme (33.3%). Each Finalist will advance to Round 2: Public Voting and Final Judging to Determine Winner, subject to verification of eligibility. The selection and review process may occur on a rolling basis as Entries are received. In the event of a tie, the Judges will break the tie by selecting the tied entrant who received the highest points from the Judges for Overall Excellence to Theme to advance. In the event a tie remains, an additional tie-breaking Judge will judge the tied Entries, using the Judging Criteria, to determine which of the tied Entries will advance. Sponsors reserve the right to pick fewer than five (5) Finalists (or none at all) or to extend the Contest Entry Period if the Contest does not receive a sufficient number of eligible and qualified Entries, as determined by Sponsors in their sole discretion.
Round 2: Public Voting and Final Judging to Determine Winner: Beginning on or about November 13, 2018, the Finalists’ Entries will be posted on the Website in a randomized manner for public viewing and voting. On or about November 16, 2018 at 11:00 A.M. ET until November 25, 2018 at 11:59 P.M. ET, or on such other dates and at such other times as determined by the Sponsors in their sole discretion (the “Voting Period”), visitors to the Website may vote for his or her favorite Finalist according to Judging Criteria, voting rules, and procedures established by the Sponsors, which will be posted on the Website. Finalists will be judged based on the following: 40% public voting and 60% based on Judging Criteria from the Judges, and the Finalist with the highest score, as determined by Sponsors in their sole discretion, will be the winner (“Winner”), subject to verification of eligibility and compliance with these Official Rules. For sake of clarity, the Prize will be awarded to the Choir featured in the Entry submitted by Winner and not the individual who submitted the Entry. In the event of a tie, ties will be broken as described with regards to Finalists above. The Voting Period, voting rules and procedures and voting methods are subject to change, at the Sponsors’ sole discretion, and any changes will be posted on the Website. Voting is currently limited to one vote per person during the Voting Period, but Sponsors reserve the right to change the limit on the number of votes, in its sole discretion. Notification regarding any such change will be announced on the Website. Winner will be required as a condition of continued eligibility to sign an Affidavit of Eligibility, Waiver of Liability, and, except where prohibited, Publicity Release (collectively, “Contest Documents”) within twenty-four (24) hours of such notification. Noncompliance within this time period will result in disqualification. If the potential Winner cannot be reached or is found ineligible, cannot or does not comply with the foregoing requirements and these Official Rules, if Prize or prize notification is returned as undeliverable, or if it does not satisfactorily execute all of the Contest Documents, potential Winner will be disqualified and Sponsors will award the Prize (defined below) to the runner-up Finalist.
PRIZE: There will be one (1) prize (“Prize”) awarded to Winner. Prize will consist of the following: the opportunity for the winning Choir to perform live on NBC Connecticut’s New Haven Tree Lighting Special (“Appearance”) scheduled to take place on Thursday, November 29, 2018 from 6:00 – 7:30 P.M. Prize may be subject to certain terms and conditions as specified by issuer. Restrictions may apply.
If Winner is a minor, Prize must be accepted by Winner’s parent or legal guardian on the Winner’s behalf. Prize will be awarded to the Choir, and not the individual who submitted the Entry.
Estimated Retail Value (“ERV”) of Prize is zero dollars ($0). Actual Retail Value (“ARV”) of Prize may vary. Any difference between ERV and ARV will not be awarded. PRIZE DOES NOT INCLUDE TRANSPORTATION, ACCOMMODATIONS OR PARKING.
All details of Prize will be determined by Sponsors in their sole discretion. Sponsors reserve the right to substitute Prize (or portion thereof) with a similar prize (or prize element) of comparable or greater value. All taxes and other expenses, costs, or fees associated with the acceptance and/or use of Prize are the sole responsibility of Winner. Prize cannot be transferred by Winner or redeemed for cash and is valid only for the items detailed above, with no substitution of Prize by Winner. If Prize is unclaimed within a reasonable time after notification from Sponsors, as determined by Sponsors in their sole discretion, it will be forfeited, and time permitting, an alternate Winner may be selected from the remaining eligible Entries at Sponsors’ sole discretion.
Winner and Choir Members must be available to attend Event on or about November 29, 2018 (or such other date determined by Sponsors in their sole discretion), or Prize will be forfeited. Sponsors shall have no responsibility or liability for cancellations, delays, or any other change by any company or person providing any element of Prize, and are not responsible or liable for any expenses incurred as a consequence thereof. Date and/or time of Event is subject to change. Event is subject to cancellation. Sponsors reserve the right to change the date and time of Event subject to production exigencies. If Winner chooses to attend the Event with less than twenty (20) Choir Members, the remaining elements of Prize shall constitute full satisfaction of Sponsors’ Prize obligation to Winner and no additional compensation will be awarded. Choir Members may be required to execute and return releases of liability and, except where prohibited, publicity releases (collectively, “Choir Member Documents”), which must be returned with the Contest Documents, or Prize will be forfeited. A parent or legal guardian must accompany all Choir Members under the age of eighteen (18) and must execute Choir Member Documents on Choir Member’s behalf.
RECORDING: Sponsors, in their sole discretion, may choose to record and/or broadcast the Appearance of the winning Choir on NBC Connecticut. If Sponsors, in their sole discretion, elect to incorporate any such audio and/or video recordings (the “Recordings”) into any NBC Connecticut television shows, the taping and/or the Recordings will not be considered an employment opportunity, and Winner will not be entitled to compensation or credit thereof. Sponsors will determine the nature of the Recordings in their sole discretion. If the Recordings are broadcast, such broadcast will be at a time, for a length of time, and on a date determined by Sponsors in their sole discretion. Winner and/or Choir Members (or their respective parent or legal guardian if a minor) may be required to return completed and signed appearance releases, confidentiality agreements and such other documents as may be required by Sponsors prior to their Appearance on NBC Connecticut and/or Winner and participation in the segment or rehearsal, if any. Failure of Winner and/or Choir Members to complete and execute these documents in a timely manner, as determined by Sponsors in their sole discretion, may cause Appearance to be forfeited. The content of the Recording as, and if, finally exhibited and the number of exhibits and re-airs thereof, if any, will be determined by Sponsors in their sole discretion. Winner will not have a right of review, notice, or approval of the content of the Recordings or any exhibition or exploitation thereof. Sponsors have the right, in their sole discretion, to disqualify Winner and/or Choir, and cause Prize to be forfeited, and remove Winner and/or Choir Members from Event at any time, if any behavior of Winner and/or Choir Members is deemed by Sponsors to be disruptive or if it may or does cause damage to person, property, or reputation of Sponsors or if it otherwise violates the policies of Sponsors, or if Winner and/or Choir Members do not follow the directions of Sponsors at all times. These Official Rules and the Contest itself are neither a contract nor an application for employment.
