Husband, Wife Sue Town Over Assault Response

Man accused of trying to kill wife complains she was not arrested.

A man charged with trying to kill his estranged wife has sued the town of New Milford because he said she was not arrested for attacking him.

Neil Fergus, who is awaiting trial on charges he stabbed Catherine Fergus in 2009, said police failed to respond properly to a 2006 emergency call to their home when he says she attacked him, The News Times of Danbury reports. The couple is now divorced.

Fergus' lawsuit claims he obtained a police report that says Catherine Ferguson called 911 during a dispute at their home.

She has sued the police, claiming they failed her for notifying her husband that she had filed harassment charges against him shortly before he attacked her in 2009.

Town Attorney Randy DiBella was not available to the newspaper for comment.
