State Rests in Hayes Penalty Phase

The state has rested its case in the penalty phase of the Steven Hayes triple murder trial.

Prosecutors called witnesses Tuesday to contradict testimony by a defense psychiatrist who testified about Hayes' mental state at the time of the crime.

Hayes and Joshua Komisarjevsky are accused of killing Jennifer Hawke-Petit and her Daughters, Hayley, 17, and Michaela, 11, in July 2007.

The psychiatrist testified last week that Hayes told him he killed Hawke-Petit in a fit of rage after learning that the younger girls had been killed. He said Hayes told him Komisarjevsky killed the girls while Hayes took Hawke-Petit to the bank to withdraw money.

The rage could be considered a mitigating factor in the eyes of the jurors who must decided if Hayes will receive the death penalty for the murders.

On the stand today, Cheshire police detective Anthony Buglione testified Hayes never told him that Komisarjevsky said the Petit girls were dead. Buglione interviewed Hayes shortly after his arrest.

He also told jurors Hayes mentioned seeing Michaela Petit had changed clothes after he returned from the bank.

Prosecutors put forensic scientist John Brunetti on the stand next. Brunetti told the jury photo on Komisarjevsky's cell phone showed Michela in a skirt while alive. He then said crime scene photos of Michaela's body showed her in different clothes. The testimony seeming to try and lead jurors to believe Hayes had seen Michaela alive and in her changed clothes when he returned from the bank.

Defense attorney Thomas Ullmann suggested Hayes noticed the change of clothes earlier that morning, and not after the trip to the bank.

Jurors will be back in court Thursday to hear closing arguments. Judge Jon Blue told them deliberations will most likely begin Friday, and that he would ask them to continue deliberations into the weekend if they don't reach a decision by Friday afternoon.
